Operating Requirements and Regulations (1999)

PLEASE READ CAREFULLY: The escort permit that is being issued to you is not a license to conduct an escort service business. To legally work as an escort, you must be employed by someone who possesses an escort service business license. If you perform nude entertainment, lingerie modeling, or other similar activities that would be considered as nude entertainment, you must also obtain a nude entertainer permit and be employed by a licensed nude entertainment business. If you perform massage services as part of an escort call, you must also obtain a massage technician's permit. You will also need an off-premise massage business license unless the service you work for has that license.

You are responsible for being familiar with and complying with the operating requirements relating to an escort, including, but not limited to: (referenced sections are San Diego Municipal Code unless otherwise indicated)

33.2810(c)
Every owner, operator, responsible managing employee, manager or permittee in charge of or in control of an escort service shall maintain a daily register containing the following information:
(1) The identification of all employees employed by such establishment together with a duplicate of each of said employee's escort permit;
(2) The hours of employment of each employee for each day; and
(3) The true identity of each patron as it appears on bona fide documentary evidence of identity issued by a governmental agency, the city and state of each patron's residence, hours of employment of escort service, name of escort or employee providing escort services, location and place where escort services took place, and fee charged.

The individual escort is responsible for obtaining the patron information required in section 33.2810(c)3 and for providing it to the escort service owner or managing employee.

An escort acting as a nude entertainer must comply with the nude entertainment requirement and stay a minimum of six (6) feet from a patron.

An escort acting as a massage technician must comply with the dress standards appropriate for a massage technician.

311.6 California Penal Code
It is a misdemeanor to knowingly engage in or participate in obscene live conduct. (This could include simulated sex acts, self masturbation, and exposing genitalia so that a person may peer into the vaginal or anal cavity.)

657(b) California Penal Code
It is a disorderly conduct misdemeanor to solicit or agree to engage in any act of prostitution. Prostitution includes any lewd act between persons for money or other consideration. (In addition to agreeing to a sex act, encouraging a patron to masturbate while you perform could be considered a violation of this section.)
