Sec. 7-30.1. Video Center License and Film or Video Viewing Device Tags.

(a) Video center license for owner of business.

(1) No person shall own or operate a business in the City of Phoenix in which is located any film or video viewing device without first obtaining a video center license.

(2) An applicant for a video center license pursuant to this Section shall provide the City Clerk with the number of machines to be located at the licensed location and a floor plan of the location showing the size and number of machines in each room, the identification number of those machines, and the size of each room in which any machine will be located.

(3) Each video center license shall be for a specific number of machines and the number of machines at the licensed location may not exceed the number allowed for in the license. An increase in the number of machines allowed for at the location requires a new video center license.

(4) The City Clerk shall be notified of any changes in the floor plan including changes in the sizes of the film or videotape devices submitted as part of the application for the video center license. These changes include but are not limited to changes in the size of rooms where the machines are located, and changes in the size, type, or number of machines located in the business.

(5) It is a violation of this chapter to place any film or videotape viewing device not tagged pursuant to Section 7-30.1(c) in a video center.

(6) Device Tags.

1. The owner of a film or video viewing device must have the machine identified and tagged before it can be placed in a licensed video center.

2. The owner of the machine must submit the following information about the machine to be tagged:

a. The name of the manufacturer of the device;
b. The type of device;
c. The serial number of the device if it has a serial number;
3. Every machine shall be tagged for identification purposes by the City of Phoenix. The tags must be affixed to the machines in a conspicuous place pursuant to Section 7-19 of this Chapter.

4. Each tag will be issued for a particular machines only. The tags shall not be transferred from machine to machine.

5. If a tagged machine is sold, the buyer of the machine shall remove the tag if it has not been removed by the previous owner and shall have the machine retagged pursuant to this Section.

6. Devices licensed pursuant to this Section may be operated at any location licensed pursuant to Section 7-30.1(a) as long as Section 7-30.(a)(4) is complied with.
